DOGE Assignment JOC-2025-[INSERT]: Undocumented Workforce: Enrollment Initiative.
This is a conceptual project, presented as a demonstration website and not a functional application. It reflects ideas generated from informal 'cooler talk' discussions – the kind of practical conversations that occur on job sites and/or in break rooms amongst the men and women performing essential, often physically demanding, labor. Responding to a widespread call among Americans for meaningful change in our workforce and immigration systems, this project aims to catalyze dialogue and explore potential solutions, particularly addressing the challenges faced by undocumented workers within various industries and those that employ them.
A secure border is paramount, and it provides the necessary foundation to effectively test our current immigration system. However, relying solely on enforcement ignores the reality of undocumented individuals already contributing to our society. A practical step would be to pair strong border control with a one-time system allowing the undocumented to earn a legal work status, further benefiting both our economy and our communities.
Utah's forward-thinking Guest Worker Permit Program in 2011 (H.B. 116 Utah Immigration Accountability and Enforcement Amendments) had the potential to create a ripple effect, which would have inspired other states to adopt similar programs. Unfortunately, it reached an impasse (12 Years Ago). Lawmakers were unable to move it forward without federal waivers, and the courts never intervened. This lack of progress not only hindered Utah but also prevented other states from exploring potentially effective solutions. 12 Years Ago we missed an opportunity to test the program.
The workaround. Today, anyone who must file or report U.S. taxes but isn’t eligible for a Social Security Number can apply for an ITIN, which is used only for tax compliance. It does not authorize work or grant immigration status. Applicants must submit original or certified copies of identity documents proving foreign status. If payroll restrictions were lifted (*if a payroll company encounters an SSN beginning with "9", it's a red flag that it's actually an ITIN and should not be used for payroll purposes.), ITIN holders could be treated as W-2 wage earners, OVERNIGHT. But, we must still contend with those that do not have the ITIN.
This first step of obtaining identification through Agent Amigo demonstrates your commitment to working within the American system and establishing a verifiable record of presence and contribution.
We understand. You've been here, contributing to our communities, working hard, and building a life. You've been a part of the fabric of our society, and we recognize your presence and your value. It's time to define who you are; where your from, how many children you have, where you live, and where you work – to establish a foundation for a more secure and recognized future. Agent Amigo is here to help you take that crucial first step. But, this time you are going to do it the right way, or risk being deported. You have until September 1, 2025 (Labor Day) to complete your registration with Agent Amigo.
You will be assigned an Immigrant Serial Number (ISN), which is a unique identifier. It mirrors the familiar nine-digit format of a Social Security Number (SSN) to ease understanding and adoption. However, unlike SSNs, which are issued by the Social Security Administration, ISNs are generated by Agent Amigo and always begin with the digit "9." This leading nine is the crucial distinction, as the U.S. SSN system has never assigned numbers with a leading “9”. This ensures that ISNs will never conflict with existing or future SSNs, providing a clear separation between the two systems while offering a familiar structure for identification. A cross-validation check with the (IRS) Internal Revenue Service to ensure no (ITINs) Individual Taxpayer Identification Numbers are duplicated. Your (ISN) provides you no access to Social Security Benefits (SSDI) or (SSI) as these entitlements are for Citizens of the United States Only.
You and your children will be directed to a conveniently located Agent Amigo enrollment center, often hosted at a community college near you. This models the approach used for COVID-19 testing and related health protocols, leveraging existing community infrastructure to maximize reach and minimize disruption. At the enrollment center, you will complete the biometric registration process. This involves capturing you and your children’s fingerprints, iris scans, and other standard biometric identifiers. In addition, you and your children’s DNA samples will be collected for a "parentage test" ("kinship test" follows all failed parentage tests).
Following the completion of you and your children's appointments, the information provided will undergo a thorough background check. You will be promptly notified of any inconsistencies or disqualifying findings. It is crucial to understand that any fraudulent activity is subject to risk of deportation for you and your family. Upon receiving your Immigrant Serial Number (ISN), it is imperative that you provide it to your employer immediately to facilitate your transition to W-2 wage earner status. This step is essential for establishing your documented work history within the American workforce system and mimics the current (EAD) employment authorization document issued by the United States Citizen and Immigration Services (USCIS) - form I-765. Like an (EAD) an (ISN) is a right to work, not a right to vote in any United States election.
As part of your transition to documented worker status, you will be responsible for paying a [2]% Undocumented Entry Fee applied to Gross Wages Earned Weekly. This fee will be deducted from your payroll and will continue until your immigration status is officially changed to Green Card. A Registered Worker Fee will be levied on Companies and Individuals employing undocumented workers, based on their payroll expenses for such workers. The fee amount will be tiered, with a higher rate applied for undocumented workers who do not have active health insurance coverage and a lower rate for those who do. This differential fee structure recognizes the varying costs associated with providing healthcare services to this population. This shared responsibility model ensures that states and local governments are better equipped to manage the costs associated with providing medical, infrastructure, educational, and other essential services, promoting a more sustainable and equitable system for all.
Regarding health insurance, participation in employer-sponsored/provided programs is mandatory. If your employer offers coverage, you must enroll. If married, family coverage is also mandatory. If your employer does not offer health insurance, and you do not have active personal coverage, an [8%] No Health Coverage Fee will be applied to your gross weekly wages. This fee is your responsibility. Your employer is responsible/ for the [2%] Registered Worker Fee for employees with employer-provided health insurance or/with active personal coverage and the [8%] No Health Coverage Worker Fee for those workers without coverage. This model reflects the health insurance cost structure that U.S. companies are managing today.
The newly established Department of Government Efficiency (DOGE) will administer the Agent Amigo program, providing oversight and strategic direction, working in conjunction with the Department of Homeland Security (DHS) and interdepartmental agencies like (USCIS) and others. DHS, in collaboration with the External Revenue Service (ERS) and working in tandem with the IRS, will handle all financial transactions, including the collection and distribution of funds. This includes the [2%] Undocumented Entry Fee, and if required the [8%] No Health Coverage Fee,which will be deducted weekly from workers' weekly paychecks, and the [2%] Registered Worker Fee with provided or/with active personal healthcare coverage or the [8%] No Health Coverage Worker Fee for those without coverage, which will be applied to the payroll expenses of businesses employing undocumented workers and also deducted weekly. Simply (2) new tax levy lines will appear on the Registered Workers W-2 indicating the Undocumented Entry Fee and No Health Coverage Fee (if applicable) and (2) new tax levy lines will appear on the Employers Form 941 indicating the Registered Workers Fees and No Health Coverage Worker Fees.
Collected funds will be strategically directed toward several key areas: offsetting societal costs associated with undocumented labor, including expenses related to medical care, education, infrastructure, and public services. The ERS will ensure operational transparency by providing detailed reporting on collected fees and their allocation, promoting accountability and public trust. By mandating participation from all employers, the ERS aims to create a level playing field, reduce competitive disparities, and incentivize compliance with ethical employment practices.
The choice is yours. By September 1, 2025, you must possess a valid Immigrant Serial Number (ISN). If you do not, you and your family risk deportation. This is not a threat, but a statement of policy. We have offered a path to legal working status; failing to take it will be considered a deliberate decision to remain undocumented, and we will act accordingly. Labor Day, 2025, will mark the official conclusion of the ICE aiAgent Amigo and Enrollment Initiative.
A conviction for an aggravated felony will have devastating consequences for those issued an (ISN) Immigrant Serial Number, including the revocation of their (ISN). Under U.S. immigration law, aggravated felonies encompass a wide range of serious offenses, including violent crimes such as murder, rape, and sexual abuse of a minor; Human & drug trafficking; fraud of $10,000 or more; and other serious crimes. This includes convictions related to illegal drugs, crimes of moral turpitude (such as theft, assault, statutory rape, robbery, and domestic violence), and other serious offenses like perjury, tax evasion, child abuse, money laundering, and weapons charges. A conviction will trigger removal proceedings and lead to automatic deportation, permanent inadmissibility to the U.S., no possibility of reentry, and ineligibility for immigration relief such as asylum for the convicted individual.
It's important to note that while a conviction for an aggravated felony will lead to the deportation of the individual with the ISN, it will not automatically result in the removal of their family members from the United States. Family members may still have options to remain in the country, depending on their individual immigration status and circumstances.
The Agent Amigo program recognizes the importance of a fair process. While participants are currently undocumented, they will be afforded certain due process protections. This includes the opportunity to provide information and be heard regarding their registration. While not equivalent to the full due process rights afforded to citizens, these protections aim to ensure a degree of fairness and accuracy within the program's framework. Further details regarding these procedures will be provided to all participants.
(ITEP) Institute on Taxation and Economic Policy states: "Providing access to work authorization for undocumented immigrants would increase their tax contributions both because their wages would rise and because their rates of tax compliance would increase. Under a scenario where work authorization is provided to all current undocumented immigrants, their tax contributions would rise by $40.2 billion per year to $136.9 billion. Most of the new revenue raised in this scenario ($33.1 billion) would flow to the federal government while the remainder ($7.1 billion) would flow to states and localities."
Statement of Understanding: Illegal immigrants improve the finances of Social Security and Medicare for a simple reason: Although illegal immigrants are generally not eligible to collect Social Security and Medicare benefits, many still pay taxes into the system. These taxes function as free contributions to the trust funds, as long as the illegal immigrants remain ineligible for benefits. A proposed (ISN) provides no access to Social Security Benefits (SSDI) or (SSI) as these entitlements are for Lawful permanent residents who have worked and paid Social Security taxes in the U.S. for at least 10 years (40 quarters) are generally eligible for Benefits. This includes retirement, and disability. It is imperative that the (ISN) cardholder begin the process of obtaining a Green Card which changes Social Security Benefits eligibility status. Your new aiAmigo is going to help prove your consistent CONTRIBUTION to the American Workforce.
